In June 15, 2012 the President Obama announced a new process of Deferred Action for young people between the ages of 15 and 31, who have graduated from American Schools or are presently attending school, and have good moral character. Initially, qualifying applicants will obtain a work permit for 2 years, a social security number and the right to government identification or driver's license. It is expected that the program will be extended and/or applicants will be given the right to receive lawful permanent residence (DREAM ACT).
To qualify to this program, you must answer in the affirmative the following questions:
Were you younger than 31 at June 15, 2012?
Did you enter the United States before your 16th birthday?
Have you continuously resided in the United States since June 15, 2007?
Were you in the United States on June 15, 2012?
Were you illegally (no legal status) in the United States on June 15, 2012?
Are you attending school, or do you have a High School Diploma or GED Certificate, or can you return to school or obtain a GED certificate?
If you answer "yes" to the questions above and you have no criminal records, you definitely qualify for Deferred Action. However, having an arrest or conviction does not automatically disqualify you. If you have been convicted of one or more crimes, you would need to answer "NO" to all of the questions bellow to be able to receive the benefit:
Have you ever been convicted of a felony?
Have you ever been convicted of a misdemeanor with a sentence of at least 90 days of jail?
Have you ever been convicted of three or more misdemeanors (not including traffic violations?
Have you ever been convicted of any of the following crimes: DUI, burglary, domestic violence, sexual abuse, firearm violations, distribution or sale of controlled substances?
